Few would deny the observation that our current court system is ill-equipped to deal with the sheer volume, the legal complexities, and the emotionally-laden conflict that comes hand-in-hand with divorce and family law in the modern age. Lawyers have moved in large numbers to embrace Alternative Dispute Resolution, including the highly-specialized sub-sets of mediation, arbitration, collaborative law, cooperative law, etc. What are these various forms of ADR and how do they differ from one another?
For well over a century Washington State did not recognize common law marriage (pejoratively referred to as a “meretricious relationship”). The law has changed in recent years and is currently in a rapid state of flux, particularly as to how lawyers and courts are beginning to address the break-up of a same-sex relationship. Our article on this topic is “under construction” and will be posted shortly. This very subject is one of our seminar topics for our March 21, 2008 CLE – “Changing Law, Changing Approaches.” Stay tuned.
